The execution of Mumbai serial blasts conspirator Yakub Memon has generated more heat than settling the dust. It has again revived the debate over utility of capital punishment. For, one thing, the brother of dreaded Mumbai underworld mafia Tiger Memon, is at the center stage of being hanged for "less crime". He is believed to be the part of the gang that planned the blasts in the aftermath of Babri Masjid demolition by saffron brigade led by Lal Krishan Advani. The main conspirators, Tiger Memon and Dawood Abrahim, both are fugitive. They have fled the country soon after the Mumbai Blasts in 1993 never to return India. Since, police couldn't lay hands on Tiger and Dawood, Yakub turned out to be a big catch, He was used as a cover up by Indian police for Dawood and Tiger Memon.The arrest of Yakub Khan was shown at Delhi railway station whereas he surrendered to Kathmandu police at Airport in July 1994 and then deported to India in a secret mission, writes eminent journalist S Hussain Zaidi. Interestingly, Zaidi's claim hasn't been contradicted by Indian authorities. Zaidi says Yakub Memon is the biggest loser in the trial despite the fact that he (Memon) lend so much credence to the evidence on which court decided the case. A day before his execution, TV Today, the leading news channel relayed Yakub's interview with the channel. In the interview, Yakub came out with some startling revelations and one of it was that he never traveled to Delhi on his own and never saw Delhi railway station . He was rather brought in to Indian capital by cops. This strengthens Mr. Zaidi's version that Yakub wasn't arrested in Delhi. As a corollary to this, It is natural to believe that Yakub was so tortured by police as to make him confess what cops wanted. The Yakub Memon trail also brings to fore the "motivated' investigation in India. The "corrupt' and highly political subservient police in India is hardly believed to be an independent probing agency. One may agree with Zaidi or not, but hanging a human being, how hard criminal he might be, tantamount to sate terrorism. No civilized society can allow this. How cruel it is and the act reminds us of Islamic State barbarism, By hanging aren't we doing the same ct, the dread ISIS men are doing in middle-east. The motivating principle behind execution of a human is that capital punishment deter the criminals and crime but the data shows the different picture. During 2000-10, only one man was executed but it didn't make ant determent on crime. There were as many as more than 33,000 crimes. Studies also show that there is no relation between death sentence and criminal acts. A man is hardly aware of the legal implication of the crime at the time of his act. Our legal system is also full of errors and biases. No legal system in world is perfect and no harshest punishment can deter the crimes. As a civilized society, let us do away with capital punishment.
